Extending Your Stay

J-1 scholars

Your department should start the request process for a program extension at least 3 months before the end date on your DS-2019. Any request that's submitted after your end date will be denied, and you'll have to leave the US within 30 days.

Each J category has a maximum time limit, and your extension request can't exceed the limit for your category. Limits by category >>

The extension request is similar to the general request process, and you will need to provide proof of financial support, proof of health insurance, and any updates to your personal information.

You shouldn't travel abroad until you get your new DS-2019.

H-1B scholars

If your department is willing to sponsor you for an extension, you can stay in the US for up to 6 years total. Each individual extension request can be up to 3 years.

At least 8 months before your I-797 expires, you should discuss extending your stay with your supervisor. 

Your department will begin the process for requesting an extension, and you'll need to provide them with the same supporting documentation you provided when you first came to the US (with any updates).

Once your department initiates the process of filing your extension, there are potential risks involved with traveling abroad. If you are planning to travel, discuss your plans with your ISSS advisor before making any arrangements.

O-1 scholars

O-1 status can be extended in 1-year increments.

At least 8 months before your status expires, you should discuss extending your stay with your supervisor.

Your department will begin the process for requesting an extension.

As a general rule, you should be careful about extending O-1 status for more than 6 years. Although USCIS does not have a maximum length of time that you can stay in O-1 status, in our experience, requests to stay in the US for more than 6 years are scrutinized more closely.

Once your department initiates the process of filing your extension, there are potential risks involved with traveling abroad. If you are planning to travel, discuss your plans with your ISSS advisor and your outside immigration attorney before making any arrangements.

TN scholars

You have 2 options for extending your TN status:

  1. Return to Canada or Mexico and re-apply for admission to the US in TN status at the port of entry. You will be admitted to the US for up to 3 years.
  2. Apply for an extension from within the US at least 3 months before your end date. You will need to provide evidence that you meet the educational and licensing requirements for your position. Your department will start this process.

You can travel while your extension is pending, but you should let your ISSS advisor know about your travel plans beforehand.
