Promotions
ISSS needs to approve any promotions or changes to an international employee's job title before they take place.
The next step depends on the employee's immigration status.
H-1B scholars
Promotions require a new H-1B petition filing before the promotion can take place. The process is the same as the initial H-1B petition filing. Visit here >>
O-1 scholars
Promotions must be reviewed carefully before it takes place. Contact your ISSS advisor who handled the current (previously filed) O-1 petition to start the discussion. If you are not sure, please email isss@emory.edu.
TN scholars
- Log in to ISSS Link and fill out the promotion request e-form under TN Employee Management. You'll need to upload the promotion request letter here.
- ISSS reviews the request and evaluates whether an amended petition needs to be approved by the Department of Homeland Security (DHS). We will email you to let you know if the employee can be promoted at this point or whether an amended petition is needed first.
- If the promotion requires approval from DHS, then you have 2 options:
- The TN employee can travel to Canada or Mexico and present a new employment offer letter at the US port of entry. Note that Mexican citizens might have to apply for a new TN visa stamp before they can return to the US. —or—
- Your department can file a form I-129 with USCIS.
- If the TN employee chooses to travel, they can assume their new position when they re-enter the US. If your department files an I-129, we need to receive a receipt notice from USCIS before the employee can be promoted. Once a petition is filed, it normally takes 3 weeks to get a receipt notice. ISSS will email you when it is received.
