Request Processing Times

H-1B employees

Hiring departments should submit requests 8 months before an H-1B employee's employment start date or their status expiration date.

Three-steps of the H-1B petiton:

  1. The H-1B required wage analysis (done by Emory HR)
  2. Filing a Labor Condition Application (done by Emory HR)
  3. Filing an H-1B petition with USCIS (done by ISSS)

The process begins with Emory's Human Resources department and then involves the US Department of Labor before coming to ISSS. After that, the request is routed to the Department of Homeland Security. Any immigration request related to an H-1B employee—including the initial request, extensions, and other employment changes—take 4–6 weeks for ISSS to process. This does not include Emory HR or federal agency processing times.

Permanent residency

Depending on the category that the scholar is qualified for (EB-1, EB-2, etc.), the permanent residency process can vary widely.
